Spoken with nierra , she said she already told Mr Khoo (Site Supervisor BJD) abt the leaking. She ask me to follow up with Mr. Khoo at 90185970..i try to call but nobody pick up the line at all.What r they doing ? :cry:

dear all, So sad looking at my parking bay....leaking so seriouly last nite...and water ponding at the ground floor parking at block C . I cant park my car there.hv to park outside.but dun know who parking lot is that? I want to said sorry to the owner .Sorry.

spoken to nierra again.she said told mr. andrew and mr. koo.they will rectify it ...but dun know WHEN? I said i started complaint this leaking since early Apr..now mid of jul...(HOW MTH MTHS ALREADY)...is not the new case.Still said will rectify it. STUPID Answer.

Hi KSC, Now wud b a very good time t take pictures of the leakage+water ponding @ the parking lot.....Hope that u could pass me some photos too :) In the mean time u wud like to consider parking at uppper level as nx to my lot still empty Thanks

I think our new friend Makurut has a point. The leaking car park roof is due to a structural fault, so this has to be dealt with by the developer/contractor. The Management is only concerned with running the office and handling other day to day matters. So KSC, I think you should get your lawyer to write to the developer, giving them an ultimatum to rectify the fault, failing which you may sue for any damages done to your car.

tks, firstly, the superficial cracks that allow water thru are not structural faults... it's sheer defective workmanship. structural faults are those that compromise the safety of the building... eg cracks along the support beam and such. a building development is a team effort. you may have the best draughtsmen and engineers but if you have lousy workmen and supervisors, then forget about world-class workmanship (it works in reverse too!) it is the responsibility of the management to maintain the building... that includes ensuring the leaking ceiling is attended to. rightfully, they will inform the developer and the developer will rectify the problem. however, in this scenario, one of two things may have happened i.e. they never bothered informing the developer to rectify the defects within the defect liability period or the developer buat tak tau. but yes, ksc... the option to seek legal redress is open to you to pursue. cheers!

Darric, Be it the structural faults or sheer defective workmanship,aren't they all fall under the defects definition and the obligation to rectify is on BJD? For all my defects in my unit, I never liaise with management, I liased directly with BJD and I get all that done in a day or max a week. Get a solicitor to write in to put them on notice may be a good option, you need that in view of the expiring defect liability period, and in case they deny they never receive such complaint..... Cheers!

shirley, i must admit... since our parking bays are "complimentary", i'm not sure whether it falls under the category of being an individual's property or common property. anyway, ksc... as shirley suggested, put them (bjd) on notice and give them the 30 days notice to rectify. in the meantime, get a contractor to assess the cost of repairs. upon expiry of 30 days, give them a copy of the estimated cost of repairs and put them on notice that if they still fail to rectify, you will engage your own contractors to do so at their cost. go file a claim at the tribunal, if you must. i think you've suffered long enough.

darric, yes, common area can be quite difficult to be categorised, but since the developer take their own sweet time to rectify the leakage and risk the car for damages, if i were KSC, I will argue on the basis that the unit and car park lot is considered ONE for the purpose of enforcing my rights under the SPA's defect rectification claims. Btw, developer's solicitor still hold on to our 2.5% of purchase price as stakeholder sum which is due at the expiration of the defect liability period.(The first bit of 2.5% has been released to BJD 6 mth after we obtained the VP). Any rectification costs incurred by the purchasers can be deducted against the said sum, based on Block C average selling price, you may still have RM4,000 there. Take a look at your VP letter, the BJD's solicitor details is there. Write to both parties concurrently. I do not think the lawyer, once you have put them on notice, will dare to release the said sum to BJD simply because they are "stakeholder".

dear all, thanks for all infro. The Mr andrew called me on wednesday 20/7/05 , he asking me any bjd ppl call me abt the leaking matter. Then i said NO. Then i ask him, u suppose to bring the good news to me...not asking me . How come i know wat r your bjd ppl do ? Complaint such nothing done. Is a long period . loged 4 mths complaint. Still leaking .Then i tell him. i cannot wait any more i will ask my lawyer to give u a letter. Then he said o.k. i will follow up with the siteman..becos he said he also dun know wat r they doing at site.. :( Yesterday nite very heavy rain right? My husband quickly go down to cover my car. Then this morning i found out lucky cover is not sad to said.

Dear all, I called the Andrew this morning, just need to follow up the leaking matter.then he give me the same answer . Oh god. u think im so stupid. Then i said o.k. Fine..Mr . andrew. i decide to give u a lawyer letter to claim back all damage to my car since 4 mths. Then he said slowly slowly...plsss....o.k. like this i will push them to fix it quickly . hold the letter 1st..then i said NO...4 mths more then enuf . Then he panic ..o.k. o.k. i promise 2 days i will call u back...hold the letter another 2 more days. plsss. then i said O.K... Another 2 days. If u wont call me. Letter is ready to send out. o.k. c wat happen this 2 days. Cheers!!!
