Building and Common Property Bill 2006
THE House passed the Building and Common Property (Maintenance and Management) Bill 2006 that will better protect buyers of common properties such as high-rise buildings. The Bill is aimed at reducing maintenance and management problems of strata property owners that had not been properly addressed in the Housing Act and Strata Titles Act. It will tighten loopholes at the time the buildings are occupied but the titles not yet issued. The Bill allows a joint committee to be formed by the developers and buyers to oversee the services and maintenance of buildings during the transition. A Commissioner of Buildings (COB) will also be appointed to oversee the services. Developers will also be responsible for the maintenance of the properties, and penalties would be imposed on those failing to do so. H ousing and Local Government Minister Datuk Seri Ong Ka Ting said many house owners had complained of the long waiting period to receive their strata titles. “The Act will ensure that developers cannot do anything they like and run away from the responsibility of managing and maintaining the building,” he said in his winding-up speech. “The developer and buyers will have to form a joint management committee (JMC) within 12 months. “The JMC will also determine the maintenance fee charges, depending on the type of building and maintenance work. This will reduce complaints of exorbitant maintenance fees.” Ong said the developer would still be responsible for maintenance and repairs even after the units were sold. The Bill covers all sub-divided housing units like condominiums, flats, gated communities, apartments, commercial buildings such as offices and shopping complexes, serviced apartments, mixed development sites and industrial buildings. Ong said developers must open a building management account to finance the maintenance and repair work and submit copies to the COB. On the penalties, he said developers could be fined up to RM20,000 if they failed to convene the first JMC meeting. “Developers must pay the deposit for repair works, failing which they can be fined RM5,000,” he said. “The developers will have to pay the maintenance fees of unsold units.” Ong added that lot-owners, either developers or house owners, could be fined RM5,000 if they failed to pay the maintenance charges. He also said that a list of guidelines would be set up to ensure smooth implementation and coordination of the Act for developers and buyers. “Improvements on the implementation of the Bill will be discussed and approved during the National Council on Local Governments meetings chaired by the Deputy Prime Minister,” he added. Ong said there were now 6,520 registered stratified housing schemes comprising 455,230 lots in the country. Barisan Nasional and Opposition MPs commended the Ministry for formulating the Act, which they said would better protect the house buyers. The House adjourned sine die after passing the Bill. ********************************************************** it is a good news for all of us.....i suggest v stop paying the maintenance fee until the joint management company formed......wat is ur opinion???

ISSUANCE of Strata Titles will no longer take years once the Strata Titles (Amendment) Act 2006 comes into effect next month. This Bill and five related ones were passed unanimously in the House. Natural Resources and Environment Minister Datuk Seri Azmi Khalid said the Act would expedite the process of issuance of strata titles and solve the problems of overlapping of laws between his ministry and the Housing and Local Government Ministry. He said the Act would boost the property market as it would make it easier for banks to approve loans for developers and buyers. “At present, banks are reluctant to approve loans because of the problem of strata titles,” he said. Azmi said developers would now have to transfer the strata titles within a year after the titles are approved by the Land Office. He said under the existing Act, developers must apply for Strata Titles within six months after they obtain the Certificate of Compliance and Completion. *********************************************************** another good news for all of us......lets fight against BJD

Performance Review of Ho Hup Group For the third quarter ended 30 September 2006, the Group recorded a pre-tax loss of RM5.63 million as against a pre-tax loss of RM1.55 million registered in the immediate preceding quarter. The higher pre-tax loss was attributed to a slowdown in the Group’s construction activities coupled with slower uptake of houses which led to a decline in progress receipts in respect of its property development project. In tandem with the subdued performance from the previous 2 quarters, the Group’s results for the 9 months period ended 30 September 2006 registered no overall improvement. The Group incurred a pre-tax loss of RM10.2 million on revenue of RM67.6 million for the 9 months period ended 30 September 2006. The construction division registered a pre-tax profit of RM4.1 million on the back of a RM22.1 million revenue compared with a loss of RM1.5 million on revenue of RM49.8 million for the corresponding period last year. The improved performance despite lower turnover was mainly due to gain on disposal of plant and machinery and investment property of approximately RM12.3 million and reduction in depreciation of RM3.2 million. However, the decline in revenue was mainly attributed to slow progress, coupled with deferment of commencement of certain secured projects. The property development division registered pre-tax loss of RM13.1 million on the back of a RM18.1 million revenue compared to RM3.7 million profit and RM46.8 million revenue for the corresponding period last year. The decline in performance for this division was due to slower uptake of houses which resulted in lower progress billings generated for the period. The ready mixed concrete division, recorded a 6.3% marginal decline in turnover to RM32.6 million compared with RM34.8 million for the corresponding period last year. However, competitive pricing among the suppliers has caused the pre-tax profit to decline substantially to about RM0.3 million compared with RM2.1 million for the corresponding period last year. In addition, a shortage of raw materials earlier in the year coupled with increased material prices has further dampened the profit margin. ********************************************************** hope this will not affect our management company....

Cleaners not getting paid and that's dangerous...
HI everyone, I'm new on this message board. I live in block C and i'm really sorry to hear of the break-ins all of you have to endure. Just wanna share something with you guys. Today, I was speaking with one of the cleaners. She said that her company owes her 2 months pay. I was wondering if any of you know how to contact the cleaning company. We need to make sure that everybody gets paid for the work they do. Not only then will they do their work well, they'll also be happy and not desperate for money. This will prevent them from thinking of 'alternative' ways to earn extra(i.e thiefing/stealing). Please don't get me wrong, i'm not accusing them but people can get desperate. And since they are mostly foreigners, their voices are never heard. I think the onus is on us to ensure that they live happily in co-existance with us. After all, they are the ones who walk around during the day when most of us are out. Someone help! AG

My Letter of Demand is out to BJD by today. Whoever interested in this legal action, just to inform you that lawyer has actually drafted the necessary Letter of Demand and at this point of time, legal charges will be on individual basis - but if more people joint in, this cost will also be lowered and the lawyer has agreed to give us discount. If BJD do not reply to the Letter of Demand, then we will proceed with Legal Proceedings and the legal charge for legal proceedings will be on a sharing basis between all of us who this will be a joint action and it will be considered a group of us in the same case taking legal proceedings again BJD. So don't worry about the cost, the more of us join in, the lower is our cost!

i quit paying maintenance fees almost 1 year already. i still see all the lousy looking cars illegally parking everywhere. the management only looks like they are doing something.... BLACK PERDANA WLW 5591 has been, still is and will still be there everyday at the visitor car park. Why stop others coming in when even this car is there everyday as a visitor!!! No way i'm paying maintenance fees anymore.... Even my neighbours are parking illegally 2 or 3 cars in the compound. What about the slotting of 3 cars into 1 car park!!!! What the F U C K is that!!! and now the menagement wants to legalise this by renting it out at RM60/month. This is an even more horrendous idea. They haven't solve the illegal parking and still they want to make money out of it!!!
