Let me clarify. The reason why I offered to settle at 90 % was to see whether they will settle it fast. I want them to pay the money upfront without them deducting for Maintenance & Etc. However if your advice is to forward to tribunal, I may do that. Thanks for the advice. Regards

Hi Katml, We have clarified with the developer and the outcome is they will issue another letter to my friend saying is their mistake. For the LAD claim, it will based on the final 10% booking date. This is confirm with the tribunal officer. Let me share with you all, the the developer Bukit Jalil Development, has been backlisted by Citibank. I get to know this because my application for refinance was rejected by Citibank and the reason by them is the developer is under their negative listing.

Note to philipt. You are taking risk. What will definetely says, "your cheque will release within a week.....bla,bla,bla" But their meaning a week is a year/ages. All of us experienced their attitude. By the time, you wanna change to 100% claim and get tribunal to help, it will be too late. They force you to sign the proposal that strictly written, "no further claim accepted by developer". Anyhow, this is my view, is your choice!!..... Note to max. What if the final 10% booking date is later than the S&P Agreement date?! Which date they use?! Now, there are 3 date to considered. a) date you paid 1st partial 10% downpayment and signed the S&P Pro-Forma Invoice. b) date of S&P Agreement. c) date of final 10% downpayment paid. Consulted with few friends/lawyer, developer suppost to calculate according to SPA (b). But the SPA must be the same as 1st purchase date (a = b).

May I know how many of you have already filed LAD claim with the Tribunal? I filed mine.

Which date you follow ? The S&P date or full 10% downpayment ? I have filed mine as well.

hi max, I used the full 10% payment date, as advised by HBA. When did you file it? Any news yet? I wonder if developer didn't file Borang 2 within 1 month, will Tribunal give us the award without the need to have a hearing?

Tribunal File
For those who have open file at Tribunal one month ago, Please call Tribunal to check your hearing date. I've met this bad experience at Tribunal. My hearing date passed and I didnt received any notice about the hearing. I've called Tribunal and they claimed they've posted by registered. The worst part is I've to re-summit my file and que up again (wait another 2-3 months). At the Tribunal counter, they told me wait for 3-4 months for hearing, but dont know what happen, so...efficient, my file took only 1 or 1 1/2 months. They are giving me wrong information.

LAD DATE
based on S&P Date. And we've no rights to charged developer interest for the days they drag. Interest may claimable after hearing and developer yet to pay within the grace period.

Hi Katml, According to HBA, you can follow the full 10% down payment. Maybe you can confirm this with Tribunal tel. no. 03-20998389.
