Hi I just called and was told that my cheque is ready. 8% interest? yeah, they say will pay later... and guess when? only they knows. So, katml, this guy Andrew Peris is the new top person of the Bkt Jalil Dev Sdn Bhd?

Andrew Perris is the new Senior Project Manager. And also the Head of Marketing team. In fact, he replaced Hwang SF., Remember ??!!.... I wish you could received 8% late payment. Because to collect cheque, they will insist you to sign letter of indemnity. - meaning the settlement is final.

it has been a month since the last posting. guess you all got your LADs already, no? hmm... were u guys persuaded to accept the 80% settlement by some guy at the tribunal (or less?). i think that is so sneaky. u're entitled to the full 100%. what's done's done, i guess... p.s. for those still waiting for your LADs, u have the right to the full 100%. don't fall for sweet talk.

Excuse me for my ignorance. What is a LAD? I saw some of you have received cheques. How do I get my cheque?

hi, I have won the AWARD w/ 100% claim + 8% late payment on 18th MAy 2005. Today total have 3 tenent at Tribunal & all of us won 100% claim w/ 30days grace period. And No any representative from the DEVELOPER attend the hearing.

excellent! follow up with the tribunal for the award (they will send it by registered post to you). upon receipt, make sure you send a copy to the developer (get the acknowledgment... dated & signed). i think the tribunal usually gives them 2 wks to pay from the date of receipt of the award by the developer (so make sure u send them a copy as soon as you get it!). then, if they don't give u the chq, send ltr to bhgn pengawasan & pengurusan. cheers! p.s. oh yeah, another thing, chye... when u receive the chq, insist on the 8% interest before signing the discharge letter. otherwise, that'll be the last u'll hear from them. cheers! :D

hello sengih... it depends... when did u sign the sale and purchase agreement (S&P) and when did developer send u the notice to collect the keys? apartment and facilities shd haf been ready 36 mths from the date of your S&P otherwise developer suppose to pay you LAD at the rate of 10% per annum of the purchase price for the period of delay and i think 10% per anum on 20% of the purchase price for the facilities.

Got back 100% LAD
Hi, Just come to know this site this morning from a friend of mine who bought a unit here. I got back the LAD last week with 100% refund except the 8% interest. I never know that there is a clause stating that we can actually claim interest from the LAD. Anyhow, i feel lucky coz i had accepted the offer by deducting the 2 yrs maintenance from the LAD somewhere in March 2005 despite rejecting their offer last year. This is my S&P lawyer idea coz i had sold my property (just sign the S&P) and to avoid any further delay by the developer, i called Andrew (Senior PM) and he said he will process my chq. And early this month, my friend got the chq (who except the 2 yrs maintenance) follow by me. From the above incident, I know that the chq was prepared long ago and pending for the signature way back in early 2005. And Puan Zai is very helpful and make all the initiative to call the accounts on my chq status. This experience tells me that getting a new house from a reputable developer does not mean hassle free and guarantee good workmanship. Sometimes, buying a second hand house is rather simpler and less worry. No worries on the completion and less tedious. Cheer!! :lol:

Hi Darric, I think I'm not eligible. I've checked my documents and I realized that I signed the S&P early Feb 02 and I got my letter of Vacant Posession Sep 04. Less than 3 years... :(

Hi, I just joined the group. It's a great idea to have this forum. With regards to the LAD, I 've just written a letter to the developer telling them that I do not agree with the 80% payment of the LAD. I was told that about 50% of the owners have accepted their proposal and the cheques were being prepared for those who agreed. Any one got any news - whether that's true and what's happening to the rest who did not agree? Has anyone gone to the office and made noise and managed to get the LAD 100%? Unfortunately I dont have the time, otherwise, might try going to the office and make a big fuss.. Regards, Chow

mlchow, u can chk with the rest. i for one got 100% LAD (but not without difficulty).
