New Maintenance and Management Bill I note with interest the subject on payment of maintenance fees posted in this forum and as a resident of Jalil Damai would like to add my views on the matter.
There seems to have been a lot of disatisfaction of the job of maintenance of the building by the management company appointed by the Bukit Jalil Development but I am of the view that non payment of the maintenance fees would not solve the problem at all. I am not saying that I am pro maintenance company but lets be practical, if most purchasers are not paying their maintenance fees on time, how are we to expect the maintenance company to do their job effectively! Surely the company would need expenses to pay the workers to sweep the common areas!
With regard to the new Building and Common Property (Maintenance and Management) Bill 2006 ("COB"), it would seem that the Bill has not taken effect yet and according to some sources, the Bill may probably only come into effect sometime in mid to end April. Of course I am all for the passing of this Bill.
I am sure that most of you have seen the Bill and from the reading of it, the main proints can be summarised as follows:-
1. Purpose - to allow developer together with the purchasers to maintain the common property
2. A Joint Management Body (JMB) will be established comsisting of developer and purchasers (upon convening of 1st meeting within 12 months of coming into effect of the Bill)
3. Statutory duty of developer to convene the meeting - Bill also clearly states that until the formation of the JMB, it is the developer's duty to maintain and manage property
4. Quorum for meeting - the Bill provides that the quorum of the meeting to be that one quarter of the purchasers WHO HAVE PAID MAINTENANCE CHARGES are entitled to vote (so all you active residents of Jalil Damai, please reactivate your maintenance payment account so that you can actively participate in the voting of the members to the JMB once this Bill is passed)
5. JMB shall elect a Joint Management Committee consisting of developer and not less than 5 and not more than 12 purchasers to perform the duties and conduct of the JMB.
6. A Building and Maintenance Account in the name of the development area shall be open within 6 months after the Bill takes effect and will be handled by developer until formation of JMB. Any surplus monies collected earlier for maintenance charges shall be transferred to this account.
The above are merely some of the sections of the Bill that will come into effect. Hopefully with the passing of this Bill, problems occuring now in the maintenance and management of buildings of such nature will be minimised. But then again in order for this Bill to work and also in during this interim period before the Bill comes into effect, I am of the opinion that we as residents need also be proactive (i.e corporate with the developer/management company appointed by paying the requisite fees required) in order for them to do their work well.
