I am in doubt of management ability to maintain a proper book keeping of our maintainence charges collection account (yes our trust account), and of course its utilisation. Fyi,they cant even reflect a true payment status in my recent water bill, which is just a simple recording.Looking at how BJD has "treated"us thus far, transparency of this trust account is definitely a MUST.

apparently they have installed a software to keep track of billing, payment etc. i wonder whose money they're using. sure hope it's not OURS!!! it had better not be or else.... :twisted:

Hey Darric, just a thought (correct me if I am wrong).......do you need to firstly register the residence committee with the authority? Home Affair Division under Housing Ministry's purview? (I was advised so in one of my assignment), in case our beloved developer challenge the committee's "locus standi" to act for the residents and to, amongst others, review the trust account. It may be worthwhile to consider the above (if applicable) with a view to formalize the set up, as we may one day opt for seeking direction from the Housing Ministry (last resort?) for any unresolved issues with BJD which fall under the HDA provision. It seems like there will be a committee registration certificate issued but the committee may require a list of residents (and their signatures) to whom the committee is acting for and on behalf of. Is BJD trying to take us for a ride now? RM33 million net losses at group level ?And being a subsidiary, I wonder how their HDA account works although they may have fully redeemed the whole JD master title, funding for defects work or LAD claims may be an issue now? Let’s hope for the best…until such time the strata titles be issued which will perhaps put an end to our "Developer and Purchaser" relationship with BJD. Cherio!

Hi Shirley, You are right - to be effective you need to register the committee legally with the ROS (Registrar of Societies). Hi tks, thanks for the info. The articles by National House Buyers Association are quite interesting...David versus the Goliaths !!! Is residence committee fall under the definition of "society" for the purpose of registration with Registrar of Societies? and not with any authorities under the Housing Ministry's purview? by virtue of its nature? I have to check it out. Thanks.

Dear All, We, the pro-tem committee is in the midst of registering the Persatuan penduduk Jalil Damai. That is the reason why the "pondok meeting' was done to get volunteers as AJK for the pro-tem + me seeking volunteers as a committee member/ block rep thru the forum....Sad to say till now only 1 volunteer :( Due to the very small number of committee members = 1% of the 930 unit @ JDA or 10% of the number registered in the forum, the speed of having the persatuan registered + other necessary things are very slow. If all of all of us read the HBA site provided by tks, perhaps the pro-tem would have more volunteers as AJK for the persatuan penduduk. Below is the quote fr HBA: " More often than not, ordinary owners are only interested in their own purchase and most do not even consider their part in the community. This must change, as the spirit of caring for others in the community can only improve one's life and not make it worse. " Hope that @ JDA there is a "SPIRIT OF CARING FOR OTHERS IN THE COMMUNITY" Thanks.

as ssh says, we are a selfish lot. we think, so what if block e doesn't have water... so long as my apartment has, who cares? or if block b, d & e are with only one lift and we stay in block a & c, why bother? but if water charges or assessment is high, we complaint no end. who cares is some mad man decides to jump into the pool at 2.30 in the morning, so long as he doesn't decide to stand in front of my apartment and do so. the list goes on. it's an uphill battle if the residents themselves do not care. yes, we may scream and shout but when it comes to translating that into action, who boldly steps forward to volunteer? search yourself. if all is well in your apartment and you couldn't be the least bit bothered about the surrounding since you hardly use any of the facilities anyway, then all i can say is this: IF YOU DO NOT HELP OTHERS DON'T EXPECT OTHERS TO COME TO YOUR AID WHEN YOU DO NEED IT and believe me, you will need it someday...

Hi Committee members, I refer to your recent meeting with BJD and wish to get some facts here about the CFO matter. May I know the “precise explanation” given by BJD in the said meeting with regard to the reason for the pending issuance of our permanent CFO? I noted those mails posted under other part of this forum on the similar topic. I really do not know if BJD is taking us for a ride on this matter. CFO issuance is dependant on, amongst others, individual clearance by Jabatan Perancangan Bandar DBKL (interchange fit in here?), Jabatan Kejuruteraan DBKL, Jabatan Kesihatan DBKL, Jabatan Bomba & Penyelamat Malaysia, Jabatan Perkhimatan Pembentungan, Jabatan Bekalan Air, Tenaga Nasional Berhad, etc. For whatever reason BJD has given on this matter in the said meeting (verbally?), can they furnish us a letter issued by DBKL to BJD stating the reason on the same? There must be one. (forget about their excuses if they said they are not able to obtain one just yet). Which clearance is still pending? Our SPA specifically stated that the delivery of the VP shall be supported by a certificate signed by architect….and that all conditions imposed by the authority in respect of the issuance of the CFO have been duly complied with. It is apparent that they have not done so, no? Thanks.

shirley, the temporary cf (issued by dbkl) states that the remaining condition is for the interchange to be built. i believe there is a copy of the tcf posted on the notice board of every block. not sure what the ratio is like but i do believe many purchasers bought their property pre-2002 before the amendments to the Housing Developers Act took effect. but if your s&p is post 2002, then you guys have much better protection. just food for thought... if it's post 2002, i believe they have to provide a standard form whenever they claim maintenance charges, no? (see your schedules in the s&p) cheers!

Hey Darric, thanks for the info, i must have been walking pass by the notice board blindly everyday :shock: Btw, my SPA dated prior to 2002, but the salient terms (affecting our interest as a registered owner) are pretty the same as compared to the Act updated as at 1 July 2003 (well, the copy i made reference to), no? may be the additional tribunal protection? It seems like there will be another long waiting for the CFO to be out one day. That's how the malaysia developers work!!! Thanks.

shirley, the amendments with regards to the issue of cf were a result of complaints by housebuyers. and so was the setting up of the tribunal (previously, getting your lad was indeed a daunting task... and you needed the assistance of a lawyer). as for the notice board... they are hardly noticeable anyway. they are all tucked at some remote corner. besides, those who have parking lots on the upper floors, they hardly check the notice boards (or check their mailboxes).

just an update. 1. still no reply from BJD (letter sent on 04.07.05) despite numerous calls by the committee (many thanks to our secretary, surita, for listening to the "not in" and "in meeting" replies almost daily!). 2. they have apparently revised renovation deposit to RM1k (dry) & RM2.5k wet. (see notice posted on notice block). they think we live in "prestigious & classic" apartment worth millions of ringgit each! 3. we'll be ending the signature campaign at the end of the week and submitting the petition to our yb (tan chai ho) next week. 4. letter to kementerian perumahan dan kerajaan tempatan (kpkt) will also be forwarded next week. thanks for your continued support! will keep you guys updated from time to time.
