Dear all,

I'm new tenant came in on August, I notise the swimming pool already close for quite a long time period.can anyone tell me what happening, and how long to go for the maintainance?? Crying or Very sad


*beside do our apartment have SOUNA facility??

Hi Calvin,

The management is taking longer than expected to repair the pool (not sure why). There is no sauna facility here.

Thks for reply, they pending without a reason:evil:, so no one complain on that?? do u think we should stop to pay the maintainance fee???if YES, i will DO IT IMMEDIATELY.

Hi Calvin,

I am not sure whats the reason, they say its under maintenance since a few weeks back, after that no more notice.

From the last AGM, we were informed that the management did use the excuse "maintenance fee was not paid" thats why their services are slow. Although they still cant provide the evidence to justify their claim (no accounts to show), i dont think its a good idea to stop paying maintenance fee. Have you joined the Residents' Association? There was a new committee and please do support them Smile

1) The duties of the management corporation include the following -

(a) to manage and properly maintain the common property and keep it in a state of good and serviceable repair;

(b) to insure and keep insured the subdivided building to the replacement value thereof against fire and such other risks as may be prescribed under this Act;

(c) to effect such other insurance of the subdivided building as may be required by law;

(d) to insure against such other risks as the proprietors may by special resolution direct;

(e) to apply insurance moneys received by it in respect of damage to the subdivided building in rebuilding and reinstating it in so far as it may be lawful to do so, subject to any order made by the court under section 56;

(f) to pay premiums on any insurance effected by it;

(g) to comply with any notices or orders given or made by any competent public or statutory authorities requiring the abatement of any nuisance on the common property, or ordering repairs or other work to be done in respect of the common property or any building or other improvements on the lot.

(h) to comply with any such notices or orders as are referred to in paragraph (g) given or made in respect of any of the parcels, if the proprietor fails to do within a reasonable time;

(i) to prepare and maintain, in such form as may be prescribed, a strata roll for the subdivided building; and

(j) to pay the rent of the lot.

55. Breaches of provisions of this Part.
(1) If the management corporation commits a breach of any of the provisions of this Part or makes default in complying with any requirements of or duties imposed on it by any of the provisions of this Part, the management corporation and every member of its council, and any other proprietor, who knowingly is a party to the breach or default shall be guilty of an offence and shall be liable, on conviction to a penalty expressly prescribed for such breach or default, or if no penalty is so prescribed, to a fine not exceeding two thousand ringgit.

(2) Where a requirement or duty is imposed on the management corporation by this Part, any person for whose benefit, or the benefit of whose parcel that requirement or duty is imposed on the management corporation, may apply to a court of competent jurisdiction for an order compelling the management corporation to carry out that requirement or perform that duty, as the case may be, and on such an application being made, the court may make such order as it thinks proper.

Hi Dan,

To sum it up,

(i) if the management breaches their duty, maximum fine is only RM2,000...
(ii) if we want action to be taken against them, we hv to take it to the court..how troublesome can it gets...

now no wonder they can afford to hv the "tak apa" attitude...hmm...interesting...

Let's not marry the definition of management corporation and the building management. Our CF's not in sight let alone strata title or formation of a management corporation.

That is why the mgmt is now happily getting monthly salary and they get to sit and just watch the residents getting distressed over their attitude.

Can we highlight all this matter in The Star Metro section?? I see lots of articles which was highlighted by residents who are not happy with their housing area etc.

We should published it there to highlighting that even though the government wants to curb crime seriously in our community but the developer which is a subsidiary of Ho Hup and Tan Sri Lee Lam Thye is even one of the director of BJD and also one of the chairman of the Malaysian Crime Prevention Foundation is not doing anything to help curb crimes in Jalil Damai.

guys, lets look at it from a different perspective. if all of us never pay the maintenance fee, they can't do they job also. so we have to understand what is behind all these things. The committee should bridge the communication with the management and not just complain and complain and complain.

Hi Dan,

That is some interesting facts u found out. I am sure the Star Metro will like the statistics of our break-ins and car theft. On the other hand, it might affect the reputation of our area and also our property price Razz this is tricky...

Perhaps the committee can take it to BJD. Perhaps BJD will not want the new owners at the more posh 2 1/2 stories to find out about the high crime rate in the area and do something about the security problems.

Can rare fish in the swimming pool ? it has been not in services for for than 1 month and now the water a bit smelly and the colour turn a bit greenish liao ..........so ugly.....

I think its RM5 one time registration and RM10 yearly to join the Residents Association.

JDA committee, am i right?

Calvin,

I think you better save your Rm5. I feel our committee is just another management / security guard. Nothing is done but just talk.

Committee, I sorry to said that but i just express what i see and feel after 1 year i stay here.

The small small thing not even settle and you all want to settle the big thing (eg: Install access card system at every block)

The small small thing which easy to settle just like:

1) swimming pool has no maintenance until the water are so dirty. People wear t-shirt or even pyjama jump into pool and make the water dirty.
2) two car parking at one parking lot.
3) Car without sticker park inside as permanent

We already pay for the maintenance fee (for swimming pool, security,etc), why they can't do the right job for us. I think it can be settle if all the commitee go together to see the management rathen than sent them an complain letter.

But committee just ignore this small thing. It's because you all think it's small thing, or because you all didn't use the swimming pool, or because you all is the one who park 2 cars in one lot or not even with no sticker???

Committee.. let settle this small thing first and show us some result before ask to pay money. What is RM5?? it is just a small amount. But is this RM5 paying to right thing and worth to pay it??

Hi wkl,

I totally understand your frustration. It will be three weeks now since the AGM and still no update from the new committee or plan to have a new meeting to discuss the current issues we are facing.

Despite the slow respond from the committee, we still need to have a strong number of members in RA in order to have our voice heard...and to push for CF and strata title. (we are still under TCF). You can read more in the following URL.
